Giveaway Competition Terms & Conditions

1. METHOD OF ENTRY

   1. To enter you must complete the entry form on the Ultimate Adventure Moto NZ website using your name and valid email address.

   2. By submitting the entry form participants are also agreeing to join the promoters email subscription list and to receive newsletter emails with information regarding new tours, dates, events and promotions.

   3. The winning entry will be drawn at random; the first participant drawn who is physically present at the prize draw and meets all conditions of entry will win. 

   4. No purchase is necessary to enter or win. A purchase does not increase the chances of winning. Only one entry is permitted per valid email address.
       

2. DURATION OF THE PROMOTION
   Only eligible entries received between 00.01am on Wednesday 4th September 2024 (the “Opening Date”) and 5:00pm on Saturday 7th September 2024 (the “Closing Date”) will be entered into the Prize Draw. Entries received outside of promotion dates will not be processed. 
    

3. NATURE AND VALUE OF THE PRIZES

   1. The giveaway prize is one single entry for one person on the "CHRIS BIRCH Special Southern Passes Adventure Tour 254" held between Monday 17th - Friday 21st February 2025, starting and finishing in Christchurch, New Zealand, and includes a single room accommodation upgrade. 

   2. The prize total value is NZD$7,290 including a single room tour accommodation upgrade. 

   3. The nature and value of the prize “CHRIS BIRCH Special Southern Passes Adventure Tour 254" can be found at www.ultimateadventuremoto.co.nz/chris-birch-5-day-adv-tour

   4. The prize is not redeemable for cash. The prize value is the recommended retail value in New Zealand Dollars (NZD) and is correct at the time of publishing. The promoter takes no responsibility for variations in the prize value. 
       

4. ELIGIBILITY

   1. Entry to the promotion is restricted to attendees of the Adventure Moto Australia Dirty Weekend held at Green Valley Farm, Tingha, NSW, Australia from 7-8 September 2024 who complete the online entry form using a valid email address during the advertised promotion period.

   2. Participants must be 21 years of age or over to enter.

   3. Participants must have a valid full unrestricted motorcycle licence that is valid during the duration of the tour (17-21 February 2025)

   4. Employees, directors, and management of Ultimate Adventure Moto NZ and Adventure Moto Australia, their related companies and agents associated with the promotion, the immediate families of the above listed persons are ineligible to enter.
       

5. PLACE, DATE & TIME OF DRAW

   1. The winner will be drawn at random from all valid entries received during the promotional period. The draw will take place at the Dirty Weekend prize presentation ceremony between 6.30pm and 8.30pm on Saturday 7th September 2024.

   2. The winner must be in attendance at the Dirty Weekend prize presentation ceremony at the time of the prize draw in order to claim the prize.

   3. If the prize winner does not come forward within 1 minute of the public announcement, at promoter’s option the winner will be taken to have forfeited the prize and a further random draw will be conducted and a substitute winner will be selected.

   4. The winner must meet all eligibility criteria or the prize will be forfeited and a further random draw will be conducted and a substitute winner will be selected. 
       

6. METHOD OF ADVISING RESULT OF DRAW
   The prize will be publicly announced and presented in person to the eligible winner during the Dirty Weekend prize presentation ceremony.  The result of the draw may also be advertised on the promoters and partners website(s), social media platforms, advertising platforms, and other media outlets. 
    

7. CONDITIONS OF ENTRY

   1. The prize is a single place on "CHRIS BIRCH Special Southern Passes Adventure Tour 254" commencing on 17th February 2025 and must be used on that date and is not transferrable to any other tour date.

   2. The winner must comply with all terms and conditions required to participate in the "CHRIS BIRCH Special Southern Passes Adventure Tour 254" including any rules, processes, insurance, security bond, health and safety requirements as detailed in the Tour Information Document which can be found on the website www.ultimateadventuremoto.co.nz/_files/ugd/6efd38_768dc35a1347411b821feef9873290de.pdf

   3. If the winner is unable to attend the prize tour date they can transfer the prize to another person at the discretion of Ultimate Adventure Moto NZ Ltd. This must be completed by a signed deed of transfer by both parties and provided to Ultimate Adventure Moto NZ Ltd in writing.

   4. The prize does not include any other costs of a personal nature not stated. This prize must be taken as stated and no compensation will be payable if the recipient is unable to attend the tour event or use it as stated.

   5. The prize winner is responsible for any and all costs associated with travel or transportation to attend the event, including but not limited to travel and transport expenses to and from the event, accommodation expenses, food & beverage expenses.

   6. The prize winner must provide their own personal motorcycle riding gear, clothing, footwear, safety equipment including motorcycle helmet and all personal items required to complete the event as specified in the tour information document.
       

8. PUBLICITY MATERIALS

   1. It is a condition of entry that the promoter has the right to publicise, broadcast and communicate to the public the names, characters, likeness and voice of any entrants for any promotion or matter incidental to the promotion.

   2. Entrants may be required by the promoter to participate in any photo, recording, video and/or film session(s) (the “publicity materials”) and acknowledge that the promoter has the right to use such publicity materials in any medium (including the internet) and in any reasonable manner it sees fit.

   3. The winner agrees not to sell or otherwise provide their story and or photographs related to the Promotion or being a winner of the Promotion to any other media organisation without the express written permission of the promoter.
       

9. PERSONAL INFORMATION

   1. As part of the promotion, we will collect entrants’ personal information. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the promotion. Submission of an entry is deemed to be consent by the entrant to the promoter collecting their personal information.

   2. The promoter will use the personal information to enable an entrant to participate in the promotion.

   3. The promoter may disclose entrants’ personal information to third parties including its contractors and agents, suppliers, promotion sponsors and service providers to assist in conducting this promotion and to any lottery departments as required under the relevant lottery legislation.

   4. The promoter may use entrants’ personal information for future marketing purposes regarding its products, including contacting the entrant electronically.

   5. Personal information will be stored by the promoter on a database controlled by the promoter or by a third-party service provider of the promoter.

   6. For the purposes of public statements and advertisements, the promoter may only publish the winner’s name and state/territory/region of residence.

10. RELEASE AND INDEMNITY

    1. To the extent permitted by law, all entrants release from, and indemnify the promoter against all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the promotion including (but not limited to) loss of income, loss of opportunity, personal injury and damage to property, whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

    2. Any guarantee or warranty given in relation to a prize is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth) or Consumer Guarantees Act 1993 (NZ).
        

11. USE OF SOCIAL MEDIA 

    1. To the extent that the promotion is conducted on, advertised or promoted on a social media platform owned by a third party (Platform Operator):

    2. Entrants acknowledge and agree that the promotion is in no way sponsored, endorsed or administered by, or associated with, any Social Media Platform Operator.

    3. Each entrant releases each Social Media Platform Operator and its associated companies from all liabilities arising in respect of the Promotion; and

    4. To the extent relevant to the Promotion, We agree and each entrant must agree to adhere to the terms and conditions and promotions guidelines of each Social Media Platform Operator which are available to view online on their social media platforms. 
        

12. NO CORRESPONDENCE
    All decisions and actions of the promoter relating to the promotion and/or redemption of the prizes are exercised at its absolute discretion and are final. No discussions or correspondence with entrants or any other person will be entered into.

14. LATE ENTRIES
    The promoter accepts no responsibility for any incorrectly submitted, incomplete, late, lost or misdirected entries or for any technical malfunction of any communications network.
